Heard the learned Counsel for the applicant.

By an order dated 23rd January, 2025, the Investigating Officer was directed to serve notice of the application on respondent - original applicant/accused in BA/3387/2023. 3.

A report is filed to the effect that the notice has been served on the respondent, and the respondent has given no objection to pay the amount of Rs.7,00,000/- deposited by him to the Cosmos Co-operative Bank. Ltd. - the applicant. 4.

8-IA4522-2024.DOC respondent states that he has no objection to pay the amount of Rs.7,00,000/- which has been deposited by him before the learned JMFC, Kalyan, to the Cosmos Bank, the applicant. 5.

In view of the above, the application stands allowed in terms of prayer clause (b).

The withdrawal of the amount shall, however, be subject to the final order that may be passed by the learned Magistrate in the proceedings arising out of CR.164 of 2023. 7.
