IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION INTERIM APPLICATION NO. 4536 OF 2024 IN CRIMINAL BAIL APPLICATION NO. 3889 OF 2023 Sachin Ramakant Sawant .....Applicant Vs.
The State of Maharashtra .....Respondent Mr. Satyawrat Joshi for the applicant Mr. Ashok Gawai, APP for the State Mr. C. S. Mane, Vishrambag Police Station, Sangli CORAM : GAURI GODSE, J.
DATE :
15th JULY 2025 ORDER:
1.
This application is for relaxation of the condition no. 3 IRESH MASHAL imposed while granting bail on 8th July 2024. Digitally signed by IRESH MASHAL Date:
2025.07.16 20:23:18 +0530 2.
Learned counsel for the applicant submits that the applicant is directed not to enter into the territorial jurisdiction of Sangli City till the conclusion of the trial, except on the date of trial. He submits that territorial jurisdiction of Sangli City has four police stations. He submits that the applicant be permitted to enter the 1/3
jurisdiction of Vishrambag police station. He submits that for more than a year, he has been restrained from entering the jurisdiction. He submits that the applicant is required to look after his family and thus, he is facing difficulties in view of the said condition. He submits that five witnesses are examined. He, therefore, submits that the condition be relaxed.
3.
Learned APP points out that after the order was passed on 8th July 2024, this application was immediately filed within a period of less than three months. He, therefore, submits that there is no substance in the grounds raised for relaxation of condition immediately within a period of three months of imposing the condition. Learned APP on instructions submits that the trial is still going on and thus, the reasons recorded in the order dated 8th July 2024 for imposing the condition even subsist today. 4.
Since the trial is going on, the reason for imposing the condition existing on 8th July 2024, even exist today. I see no change in the circumstances today to relax the condition. The reasons for imposing the condition are already recorded in the order granting bail on 8th July 2024. Learned APP is right in 2/3
submitting that immediately within three months, this application is filed for relaxation of condition. Since the trial is going on, I see no reason to relax the condition.
5.
Application, is therefore dismissed.
