By this application, the Applicant is seeking relaxation of condition Nos.(d) and (e) imposed by this Court (Coram: M. S. Karnik, J.) vide order dated 8th April, 2024. 2.

Learned counsel for the Applicant submits that in the present matter investigation is completed and he is attending the Court's date regularly. The Applicant is ready to attend the DB Marg police station once in a month. Learned counsel further submitted that Applicant has been restricted not leave out side the Maharashtra except permission of trial Court. Learned counsel further submitted Shantanu S. Dhudum 1/3

that the Applicant is businessman, and he needs to travel frequently out side the Maharashtra and finding difficulty to take permission every time. Hence, requested to allow the application 3.

Learned APP strongly objected to allow the application on the ground that allegations against the Applicant are that he cheated the first informant and other investors, if condition is relaxed, he may abscond. Hence, requested to reject the application. 4.

I have heard both learned counsel.

The Applicant is ready to attend the DB Marg Police station once in a month as he stays in that area. The Applicant is businessman and he needs to travel out side the Maharashtra for business purpose.

Considering these facts, I pass following order:

ORDER

i. Application is allowed.

ii. The Condition No.(d) imposed on the Applicant by this Court (Coram: M. S. Karnik, J.) vide order dated 8th April, 2024, is hereby relaxed.

iii. The Condition No.(e) is modified as under:- "The Applicant shall attend the DB Marg police station Shantanu S. Dhudum 2/3

once in a month on every Monday between 11:00 a.m. to 1:00 p.m.,till conclusion of the trial.

In view of the aforesaid terms and conditions, the application is allowed and disposed of.
