1) This is an Application for restoration of Criminal Writ Petition No. 1420 of 2020, which was admitted vide the order dated 18th October 2023 but was dismissed for non-prosecution vide the order dated 4th September 2024 for non-prosecution.

2) Learned Advocate for the Applicant/Petitioner submitted that he was not in Mumbai from 30th August, 2024 till 4th September 1/2

Shivgan 28-ia-4564-2024.doc 2024 due to his personal difficulty and therefore, he could not remain present when the matter was called out. It was on the final hearing board on 4th September, 2024. He submitted that his absence was unintentional.

3) Considering that the matter was admitted and nobody had appeared for the Respondent No.2 and also considering the personal difficulty of the learned counsel for the Petitioner, Criminal Writ Petition No.1420 of 2020 is restored to its original file with continuation of the interim relief granted vide the order dated 18th October 2023.

4) Criminal Writ Petition No.1420 of 2020 be listed on final hearing board in the week commencing from 9th December 2024.

5) Application is disposed of.
