Heard Mr. Sayed, learned Advocate for Applicant in Interim Application No.4613 of 2024; Mr. Gupta, learned Advocate for Applicant in Interim Application No.4679 of 2024; Mr. Katarnvare, learned Advocate for Respondent No.1 and Ms. Krishnaiyer, learned APP for the State.

I have heard Mr. Sayed and Mr. Gupta and the issue which is involved in the Interim Application. Both Applications seek review of the order dated 18.10.202. At the outset, in his usual fairness, Mr. Sayed would inform the Court that there are certain suggestions which may be considered by the Court for abiding with the order under review. Both learned Advocates would submit that in the interest of justice, they will not therefore press the Interim Applications seeking Review, but that should not preclude them from approaching the Court in future if the need so arises. Submissions made by Mr. Sayed and Mr. Gupta are fair. It is needless to state that it shall be open to the prosecution / parties to approach this Court in the event if the need so arises. In view of this submission no case for Review is made out. 3.
Leaving all questions open, I am inclined to accept the request made by Mr. Sayed. He would submit that the officers involved in the present case may have to present themselves in trial physically and they may be permitted to appear on video conferencing before the designated Court at Panvel. If an appropriate Application is made by the concerned officers to the designated Court at Panvel, the said officers shall be permitted by the Court to appear on VC, unless their presence is required.

Needless to state that if physical presence of any officer is required, then the designated Court shall be at liberty to so direct which shall be abided by the concerned officer.

All contentions of parties are expressly kept open. 6.
With the above directions, both Interim Applications are disposed.
