The present Interim Application is taken out seeking modification in Condition No.4 imposed vide order dated 19.09.2024, when the Appellant was directed to be enlarged on bail, subject to the condition that he shall attend ATS Kalachowki , Mumbai on first Monday of every month between 10.00 a.m. to 12.00 noon.

We have heard the learned counsel for the Applicant and the learned APP for the State.

The Applicant seek a slight modification in the said order and pray that the attendance shall be permitted to be marked on first or third Saturday of the month between 10.00 a.m. and 2.00 p.m. before the Station House Officer of the jurisdictional police station within the limits of which Applicant is residing viz. Shahupuri Police Station in Satara.

On hearing Mr.Punalekar, the learned counsel for the Applicant and on perusal of the Application, the difficulty posed by the Applicant, is about the compliance of the direction for marking his attendance in the Karnataka case (Gauri Lankesh murder case) in which also he has been directed to be released on bail with a condition that he shall report to Shahupuri Police Station, Satara.

Since the learned APP Ms.Sharmila Kaushik do not express any serious objection about the modification, we see no difficulty in modifying condition No.4 in case of the Appellant in Criminal Appeal No. 588/2024 and thus modify the order dated 19/09/2024. Though we deem it appropriate to allow the Interim Application in terms of prayer clause (A), we also direct that the Applicant shall report about any change in his address to ATS Kalachowki, Mumbai, in case, if he decide to shift from the jurisdiction of Shahupuri Police Station, Satara.

Interim Application is made absolute in terms of prayer clause (A). As a result of which, the Applicant shall mark his attendance on first Saturday of the month between between 10.00 a.m. to 2.00 p.m. before Shahupuri Police Station, Satara.
