Heard learned counsel for the Applicant and learned APP. 2.

By this application, the Applicant is seeking relaxation of the condition.

Learned counsel for the Applicant submits that this Court has passed the order on 18th March, 2024 (Coram: Madhav Jamdar, J) has granted bail to the Applicant. While granting the bail, this Court has imposed the conditions, with the imposed Condition No. Shantanu Dhudum 1/3

(c) that the Applicant shall report the Loni Kalbhor Police Station, District - Pune on the Sunday of every week between 11:00 a.m. to 1:00 p.m. until the conclusion of the trial. 4.

Learned counsel further submitted that the Applicant is residence of Latur. The Applicant is finding difficulty to attend the police station on every Sunday. Applicant attended the Court's date regularly and draft is submitted by the prosecution. The Applicant undertakes to attend the trial Court dates regularly. Hence, requested to allow the application.

Learned APP strongly objected to allow the application on the ground that the offence under Section POCSO Act and under section 376 of the Indian Penal Code, 1860 (for short "IPC") both sections are registered against the Applicant. Hence, requested to reject the application.

I have heard both learned counsel.

The Applicant shall attend the Court's date regularly. The draft charge submitted against him. The Applicant undertakes to attend the Court dates regularly. Considering these facts, I pass allowing order.

(i) The application is allowed.

(ii) The condition No.(c) is relaxed.
