This Court by order dated 1st April, 2024 while releasing the applicant on bail has inter alia imposed the following condition :

"(b) The Applicant shall not enter the Kolhapur district after being released on bail, except for reporting to the Investigating Officer if called, and for attending the trial."

The learned counsel for the applicant submits that the applicant is the only earning member in his family. It is submitted that the children of the applicant are taking education in Kolhapur. It is thus submitted that the above by SAJAKALI LIYAKAT JAMADAR Date:

On the other hand, the learned A.P.P. for the Respondent-State submits that considering the over all facts and circumstances of the case, the above condition was imposed and therefore condition may not be relaxed. 4.

Considering the over all facts and circumstances of the case, I am inclined to modify the condition in question. Hence, I proceed to pass the following order :

ORDER

(i) Interim Application is partly allowed and the condition in question is substituted with the following conditions.

(ii) The applicant shall not enter into the Corporation limits of Kolhapur City, till conclusion of trial. (iii) The application is disposed of in the aforesaid terms.
