Heard learned Senior Counsel for the applicant and learned APP for the respondent-State.

In terms of the earlier order passed by this Court, today, the learned APP has produced a report dated 10th December 2024 of a Committee of Doctors of various departments of the J. J. Hospital. It is reported that, upon perusal of the documents pertaining to the applicant and his health status, it is not necessary to admit him in the hospital and that he can be treated as an outpatient. The learned Senior Counsel for the applicant submits that there is a document available with the applicant to show that the Government Doctors themselves have taken note of the fact that

bipin prithiani 3-ia-4841.24.doc the applicant has been vomiting blood, as recently as on 9th December 2024 and therefore, it is an extremely serious matter. It is submitted that the applicant has a right to be treated in a private hospital, for which purpose interim bail for a limited period of 1 month is being sought.

In these circumstances, it would be appropriate to issue directions to the respondent-State.

The respondent is directed to produce the applicant before the same Committee of Doctors that has submitted the report dated 10th December 2024, along with any other Specialist Doctor, if required, on 13th December 2024 at 10:00 a.m. The Doctors will examine the applicant in the backdrop of his health status and history, as recorded in document dated 9th December 2024. After admitting the applicant, if necessary, and examining him thoroughly, the said Committee shall again submit a report, on or before 16th December 2024, along with documents. 6.

List this application on 16th December 2024, to be listed First on Board.
