The order dated 30/07/2024 directing the release of the Applicant on bail pending the Appeal filed by him, imposed a condition that he shall attend ATS Kalachowki on first Monday of every month between 10.00 a.m. to 12.00 noon.

The present Interim Application is taken out for modification of the said condition and in support of the said Application, Mr. Punalekar the learned counsel for the Applicant has invited our attention to the Digitally signed by RAJSHREE KISHOR MORE Date:

2024.11.29 15:06:33 +0530 order passed by the Karnataka High Court on 04/09/2024, where a RAJSHREE KISHOR MORE condition was imposed upon him that he shall not leave the jurisdiction of trial Court until the case registered against him is disposed off. This order was modified by a subsequent order and the Petitioners were directed to mark attendance on first and third Saturday of the month 1/2

(904)IA-4849-2024.doc between 10.00 a.m. and 2.00 p.m. before the Station House Officer of the jurisdictional Police Station within the limits of which the Petitioners are residing.

Complying with the present condition of reporting to ATS Kalachowki on First Monday of every month , has put the Applicant in difficulty and therefore the relaxation is sought from its compliance. Mr. Punalekar would submit that he will mark his attendance in ATS Kalachowki, Mumbai on second Saturday between 10.00 a.m. and 12.00 noon, once in three months, whereas, on the first Saturday of other two months he shall continue to mark his attendance in Shikaripura Rural Police Station in Shivamogga District ( Karnataka), where he is residing.

In the wake of above, the Application is made absolute in terms of prayer clause (A), by directing the Applicant to mark his attendance on first Saturday of two months before the Station House Officer in Shikaripura Rural Police Station, Shivamogga District (Karnataka). In addition, he shall mark his attendance on the Second Saturday of the Trimester, before ATS, Kalachowki.

The order dated 30/07/2024 stands modified accordingly and the Interim Application is disposed off.
