The Interim Application seek restoration of Criminal Application (APL) No. 976 of 2016 by setting aside the order of its dismissal dated 18.04.2022.

We have heard the learned counsel for the Applicant and the learned A.P.P. for the State. In the past also when the Criminal Aplication was dismissed for want of prosecution, it was restored on 30.07.2024 subject to the payment of deposit of cost of Chaitanya

2/2 44-Ia-4934-2024.doc Rs.10,000/- to the Kirtikar Law Library. Once again the Criminal Application was dismissed on 08.10.2024. On hearing the counsel for the Applicant, and for the reasons stated in the Interim Application, we have satisfied with the bonafides and therefore direct restoration of the Criminal Application (APL) No. 976 of 2016, but this time it shall be subject to deposit of cost of Rs.20,000/- to the Kirtikar Law Library, within a period of two weeks from today. Subject to the aforesaid compliance, Criminal Application No. 976 of 2016 stand restored to its file and Interim Application stand disposed off.

List the Criminal Application (APL) No. 976 of 2016 on 26.03.2025.
