3) Application is accordingly allowed in terms of prayer clause (a).

4) The Appellants are directed to implead CIDCO as Respondent No.4. Necessary amendment be carried out within a period of two weeks from today and duly amended copy of the Appeal memo be served upon learned Advocates for the Respondents within same stipulated period.
