During the course of arguments, the learned counsel the applicant made a specific submission that the informant had moved an application before the Jurisdictional Magistrate on 28th November, 2022, making allegations against the applicant, praying for registration of the FIR. The said proceeding, according to the applicant, is still pending and yet the subject FIR has been got registered against the applicant. 2.

The learned APP as well as the learned counsel having instructions to appear on behalf of the first informant submit that they will take instructions in this regard.
