T.G.Khan, learned APP for Respondent-State.

Mr. Damre, learned Advocate for the Applicant states that there is an error in prayer clause 9(a), which is required to be corrected as clause (f). Amendment to be carried. 3.

By order dated 29.02.2024 Criminal Bail Application No. 705 of 2024 filed by the Applicant was granted and the Applicant was released on bail on the conditions mentioned at

paragraph-4(a) and 4(g). By the present Application, the Applicant has sought for the following prayers:

"(a) By appropriate order or directions this Hon'ble Court be pleased to modify qua relax the condition imposed vide order dated 29/02/2024 passed by this Hon'ble Court in Cri. Bail Appln No. 705/2024 mentioned in clause (f) of the operative part of the order thereby relaxing the same by allowing the present Applicant to enter in Nashik District except Malegaon City;"

Mr. Khan, learned APP on instructions from the Investigating Officer submits that the prosecution has no objection for the Applicant to enter the City of Manmad, District Nashik for a limited period and time i.e. once in a month. Mr. Damre, learned Advocate for the Applicant on instructions from the Applicant states that he is agreeable to the said concession given by the prosecution and that he would enter town of Manmad on 5th of each month by 9 a.m. and would leave by 6 p.m. The said period would commence from the month of July, 2025.

In view of the above, no further orders are required and

the Applicant is permitted to enter town of Manmad on 5th of each month during the period strictly between 9 a.m. to 6 p.m. 6.

Mr. Damre, learned Advocate for the Applicant on instructions from the Applicant states that he would be visiting town of Manmad on the day permitted for the purpose of visiting his property and that he would strictly abide by the timeline as recorded in paragraph-5 hereinabove. Statement accepted. 7.

It is clarified that the conditions of the Bail Application No. 705 of 2024 would stand. Clause (f) of the Bail Order is modified to the limited extend as stated above. 8.

In view of the above, Interim Application No. 5085 of 2024 is allowed and disposed of.
