Heard Mr. Solkar, learned Advocate for Applicant; Ms. Khatkhatay, learned Advocate for Intervenor and Ms. Bajoria, learned APP for Respondent - the State of Maharashtra. 2.

This Bail Application is heard once again today. The Applicant has been granted bail in Bail Application No.4344 of 2024.

Two specific orders passed therein namely order dated 28.11.2024 and 06.12.2024 have been placed before me. I had impressed upon Mr. Haldankar, learned APP yesterday and he assured the Court that he would take appropriate instructions and also apprise the Court today itself. He has failed to do so.

Today Ms. Bajoria appears. She would submit that she had appeared for the Respondent - State of Maharashtra in the previous Bail Application No.4344 of 2024 wherein bail was granted. She tries to justify the interim order passed in that Bail Application which records the contents of the medical report. She would submit that on medical grounds the Bail Application was not considered. 4.

Be that as it may, I am also informed by Mr. Solkar that the medical report is in an envelope placed before the Court. Registry is directed to place that envelope before me on the next adjourned date. 5.

In the meanwhile, I direct the learned APP to obtain a fresh Medical report while taking into consideration the previous report dated 24.10.2024 ascertaining the condition of the Accused. The Accused shall be presented before the concerned Board of J.J. Group of Hospital which has been appointed in the case previously to examine her within a period of one week from today by the prosecution. The said concerned Medical board shall examine her present medical condition on all parameters including the issue whether after the last

report whether she received the treatment / injections as prescribed and a fresh report shall be prepared while taking into consideration the previous report dated 24.10.2024 to enable this Court to consider the medical condition of the Accused for deciding this Bail Application. 6.

List the matter on 16th January, 2025.
