Heard the learned Counsel for the parties.

This application is preferred to modify the condition of attendance imposed while releasing the applicant on bail by an order dated 8th February, 2024. Condition No.(iii) of the said order reads as under:

(iii) The applicant shall mark his presence at Santacruz Police Station on first Monday of alternate month between 11 am to 1 pm for a period of three years or till the conclusion of the trial.

In the application is averred that the applicant is a resident of Rajasthan and has been suffering from Tuberculosis. 1/2 Order corrected as per order dtd.23/1/2025.

15-IA5171-2024-SPM.DOC The applicant, therefore, finds it onerous to attend the police station once in two months. Copies of the medical papers are annexed to the application.

The condition of attendance was imposed to ensure that the applicant's presence can be secured at the trial. In view of the reasons assigned in the application, the condition of attendance can be modified to the effect that the applicant shall mark his presence at the police station twice a year. 5.

Hence, the following order:

The condition No.(iii) of the order dated 8th February, 2024 stands modified as under:

"The applicant shall mark his presence at Santacruz Police Station on 31st January and 31st July of each year till conclusion of the trial."
