The learned Advocate for the Petitioner submits that after the amendment is carried out and because the charge has been framed, which is being assailed, the matter would lie before the learned Single Judge in view of the order dated 9th February, 2024 passed by this Court (Coram: Prakash D. Naik and N.R.Borkar, JJ.) in Writ Petition No.95 of 2023.
