Heard the learned counsel for the parties.

The learned counsel for the respondents/applicants in ABA informs the Court that the applicant/first informant had invoked the civil remedy. The applicant has resorted to pre-institution mediation under section 12A of the Commercial Courts Act, 2015. Mediation has failed.

As the applicant has resorted to civil remedy, there is no propriety in entertaining the instant application. 4.

Needless to clarify that the amount deposited by the applicant and the interest accrued thereon, would abide the final outcome of the proceeding arising out of C.R. No. 21 of 2022. Application disposed.
