This application is for relaxation of condition no.3 of order dated 6th March 2020, releasing the applicant on bail. By condition no.3, the applicant was directed to report to the concerned police station once in a month on every Saturday till further orders. Learned counsel for the applicant submits that though the chargesheet is filed in the year 2018, the trial has not proceeded and even charge has not been framed till date. He further submits that the applicant is regularly attending all the dates in the trial court. He submits that considering, the health condition of the applicant, this application is filed for relaxation of the condition to the attend police station.

Learned APP submits that if the condition to attend the police station is to be relaxed, the applicant may be directed to attend the police station as and when called and shall attend all the dates in the trial court.

Considering the aforesaid facts and since the charge is not yet framed though chargesheet is already filed, the condition no.3, directing the applicant to attend police station can be relaxed, subject to the applicant attending the concerned police station as and when called.

The application is therefore allowed by passing the following order:

I) Condition No. 3 in the order dated 6th March 2020 is relaxed, subject to the applicant attending the concerned police station as and when called by a written notice. II) It is clarified that the remaining conditions of the order dated 6th March 2020, would be binding upon the applicant and shall continue to operate.

III) It is further directed that the applicant shall attend all the dates in the trial court unless exempted by a written order by the concerned court.

IV) Subject to the aforesaid clarification and on the Page no. 2 of 3

condition that the applicant shall attend all the dates in the trial court, the condition no.3 of the order dated 6th March 2020 is relaxed and modified in the aforesaid terms. 5.

Interim Application is allowed in the aforesaid terms. 6.
