This is the second application preferred by the applicant seeking suspension of his sentence and enlargement on bail. The applicant's first application seeking suspension of his sentence and enlargement on bail filed in the aforesaid Criminal Appeal was dismissed as withdrawn, when the Court was not inclined to suspend the substantive sentence and release the applicant on bail. The same is recorded in the order dated 5th September 2022, passed by this Court [Coram : A. S. Gadkari & Milind N. Jadhav, JJ.] in Interim N. S. Chitnis 1/2

Considering the aforesaid, judicial propriety requires that the present application also be placed before the same Bench. 3.
