By this Application, the Applicant is praying for relaxation of the bail conditions imposed by this Court. 2.

The learned counsel for the Applicant submits that, this Court (Coram : N.J. Jamadar, J.) by order dated 18th January 2024 has released the Applicant on bail and has imposed the condition that, the Applicant shall mark his presence at Kandivali Police Station on First Monday of every alternate month in between 11 a.m to 1.00 p.m. till conclusion of the trial and N.S. Applicant shall not enter in the area of Jadhuwali Galli No.1, Gandhi Nagar, Kandivali (W) till the conclusion of the trial. 3.

The learned counsel further submitted that, the charge-sheet has been filed against the Applicant. Initially, offence was registered against the Applicant under Section 326 of IPC and it is altered to Section 324. The Applicant is student of BCA and he has to attend college regularly. Hence, requested to allow the Application.

The learned counsel APP strongly objected on the ground that, if condition is relaxed the Applicant may abscond. Hence, requested to reject the Application.

I have heard both learned counsel. perused order passed by this Court.

Considering the submission of both learned counsel as well as charge is altered against the Applicant under Section 324 and he is student. Considering these facts, I pass following order.

ORDER

(i) The Condition No.(4) and (5) imposed N.S. Kamble page 2 of 3

on the Applicant by this Court (Coram :N. J. Jamadar, J.) by order dated 18th January 2024 is relaxed.

(ii) The Application is allowed in the aforesaid terms.
