IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION CRIMINAL APPEAL NO. 545 OF 2017 WITH INTERIM APPLICATION NO. 5339 OF 2024 IN CRIMINAL APPEAL NO. 545 OF 2017 Santosh Laxman Niskate ...Appellant

Versus

The State of Maharashtra

...Respondent

Mr Shivraj R Patil, for the Appellant/Applicant. Ms Kranti T Hivrale, APP, for the Respondent-State. SHEPHALI SANJAY MORMARE

CORAM:

SUMAN SHYAM & SHYAM C. CHANDAK, JJ.

SHEPHALI SANJAY MORMARE Date: 2025.08.06 18:28:54 +0530 DATED:

6TH AUGUST 2025.

PC:- 1.

After hearing the submissions made by the learned counsel appearing for the Appellant/Applicant, we are of the view that instead of taking up the Interim Application for bail, the Appeal itself should be heard and disposed of expeditiously. Ms Kranti Hivrale, learned App appearing for the Respondent-State also fairly agreed to the same proposal.

4-APEAL-545-2017+.DOC 2.

Considering the fact that the Appellant/Applicant is in jail since nearly last 12 years, despite the order dated 16th March 2021 passed in Criminal Interim Application No. 272 of 2021 arising out of Criminal Appeal No. 545 of 2017, rejecting the prayer of early hearing made by the Applicant, we are inclined to fix the Appeal for final hearing on 22nd September 2025. 3.

List the Criminal Appeal for final hearing on 22nd September 2025.
