By this application, the applicant is seeking suspension of sentence and bail during the pendency of revision application filed by the applicant.

The applicant has been convicted for the offence punishable under Section 138 of N.I. Act and sentenced to suffer simple imprisonment for six months and to pay compensation of 1/3

Rs.37,00,000/- and in default of payment further simple imprisonment for four months.

It is the contention of learned counsel for the applicant that the trial Court has granted bail and suspended his sentence for appeal period. During trial, the applicant was on bail and he has not misused liberty. Hence, requested to allow the application.

The learned APP for respondent-State strongly objected to allow the application.

I have heard both learned counsel.

The maximum sentence imposed on the applicant is of six months. The trial Court has suspended sentence till appeal period. During trial, the applicant was on bail and he has not misused liberty. It may take time to dispose of the revision. 7.

In view of above, the applicant's sentence is suspended and he is enlarged on bail, pending the hearing and final disposal of the revision, on the following terms and conditions.

i. The applicant be enlarged on bail on furnishing P. R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount. ii. The bail bond to be furnished before the Trial Court.

Interim Application stands disposed of.
