Learned senior counsel appearing for the petitioner-husband on instructions makes a statement that the petitioner shall bring the child in India on 17th September 2024. Learned senior counsel for the petitioner further submits that affidavit-cum-undertaking of the petitioner confirming the said statement will be e-filed in this court on 10th September 2024. The statement made on behalf of the petitioner is accepted as an undertaking to this court. 3.

Learned senior counsel has expressed his apprehension that in view of the criminal proceedings pending against the petitioner, coercive action may be taken against the petitioner. He further submits that the petitioner has filed a Criminal Bail Application No. 1211 of 2024, before the Sessions Court, Nashik seeking pre-arrest bail. Learned counsel for respondent no.1-wife on instructions submits that if the petitioner brings the child to India and seeks protection, respondent no.1 shall consent to grant of such protection.
