ORDER:

In view of the earlier orders passed, the petitioner is present in the court today. Learned senior counsel appearing for the petitioner submits that even the minor child is brought in Mumbai. The petition was kept back to enable the respondent to meet the child. Learned counsel for the respondent submits that the respondent has met the child.

Learned counsels for the parties on instructions submit that the parties are agreeable to explore the possibility of an amicable settlement. They request that the parties be referred for mediation. Learned counsels for the parties submit that Advocate Mr. Jayant Dattatraya Jaibhave, has agreed to mediate. By consent Mr. Jayant Dattatraya Jaibhave is appointed as a Mediator. Mediation charges if any shall be paid by the petitioner. Learned mediator is at liberty to issue necessary directions for payment of mediation charges if any. 3.

In the meantime, parties agree that the respondent shall be permitted to meet the child. By consent following order is passed for availing access by the respondent:

I) The respondent is permitted to pick up the child from Courtyard, Marriott, Nashik hotel tomorrow i.e. 19th September Page no. 2 of 3

2024 at 5: 00 pm. The respondent shall drop back the child at the same place by 8:00 pm.

II) From 20th September 2024 till 23rd September 2024, respondent is permitted to take the minor child at 10:00 am and she will drop back the child at the same place by 5:00 pm.

It is clarified that both the parties shall not discuss about the litigation with the child or in the presence of the child. It is further clarified that both the parties shall not influence the child's mind against each other.

It is clarified that till further order by this court, the child will not be taken away out of India.
