The plaintiff filed Affidavit of Service, which shows that defendant no. 5 was served with Writ of Summons on 05.04.2025, however, packets sent to defendant nos. 1 to 4 were returned as unserved.

Defendant no. 5 failed to file written statement within stipulated period of 90 days. Hence, suit against defendant no. 5 is transferred to the list of Undefended Suits.

The plaintiff to take steps to serve defendant nos. 1 to 4 with Writ of Summons and file affidavit of service till next date, failing suit against these defendants will be dismissed for non-compliance of O.S.Rule 87. Office to issue fresh Writ of Summons, if required. The plaintiff to comply directions issued, vide Practice Note 60A.

Liberty is granted to the plaintiff to serve aforesaid defendants by modes of service.
