Learned Counsel appearing on behalf of the Plaintiff submits that the Suit as filed is for a Deemed Conveyance. She submits that after filing of the present Suit, the Plaintiff Society has approached the Deputy Registrar and filed an application for Deemed Conveyance. It is thus in these circumstances she seeks leave to withdraw the present Suit.

In view of this, pending Applications, if any, shall stand disposed of.

Refund of the Court fees, if any, in accordance with the Rules. For the purposes of Section 43 of the Maharashtra Court Fees Act and the proviso to that Section, today's date is the date of making a claim for repayment. The Prothonotary & Senior Master will issue a certificate for a refund of Court Fees computed according to the Rules.
