ORDER :

By the Parsi Suit, the Plaintiff Nos. 1 and 2 have sought dissolution of their marriage which had been solemnized on November 1, 2002 by Decree of Divorce under Section 32(B) of the Parsi Marriage and Divorce Act, 1936. The Consent Terms which have been entered into between the Plaintiff Nos. 1 and 2 for seeking divorce by mutual consent in terms of the Consent Terms dated 14th September, 2024 is annexed at Exhibit-D to the Plaint. By the prior order dated 28th November, 2024 of learned by KAVITA SUSHIL JADHAV Date: 2025.01.10 16:53:13 +0530 Single Judge of this Court the Plaintiff Nos. 1 and 2 were referred to 1/3
the Marriage Counselor and appointed by the Main Mediation Centre, Mumbai. Thereafter, the Marriage Counselor who was appointed by the Main Mediation Centre of this Court has filed the Report dated 7th January, 2025. The Marriage Counselor has noted that the Plaintiff No.1 and Plaintiff No.2 had no complaints with regard to the revised Consent Terms for dissolution of their marriage. The Marriage Counselor also made observations with regard to prioritization of their children's specific needs, circumstances and psychological wellbeing above all else, alongwith seeking support and reaching out to friends, family and mental health professionals to cope with their own burnout, emotions and stress. These observations shall born in mind by the Plaintiff Nos. 1 and 2 upon the dissolution of their marriage by mutual consent.

The learned Single Judge of this Court vide the said Order dated 28th November, 2024 had directed filing of Affidavit of Evidence of Plaintiff Nos. 1 and 2. However, giving the fact that the Plaintiff Nos. 1 and 2 have sought dissolution of their marriage by mutual consent and the said Report of the Marriage Counselor dated 7th January, 2025 having been filed which Report finds that the Plaintiff Nos. 1 & 2 have no complaint with regard to the revised 2/3
signed Consent Terms for dissolution of their marriage, the requirement of Affidavit of Evidence is dispensed with. 4.
In that view of the matter, the Decree is passed dissolving the marriage of the Plaintiff Nos. 1 and 2 solemnized on November 1, 2002 under Section 32(B) of the Parsi Marriage and Divorce Act, 1936 in terms of Consent Terms (Exhibit-D to the Plaint). 5.
The Parsi Suit No.14 of 2024 is disposed of accordingly. [R.I. CHAGLA, J.] 3/3
