Having examined the record, it is evident that the Respondent has made every attempt to frustrate conduct of the arbitration proceedings. In these circumstances, despite delay in filing of this Petition, it would be appropriate to extend the mandate of the Arbitral Tribunal by a period of one year from today.

The Learned Arbitral Tribunal has been lenient in its approach to the parties perhaps with a view to secure compliance and ensure that the matter proceeds. Be that as it may, there has been an extraordinary delay primarily because of the conduct of the Respondent. In these circumstances, mandate of the Arbitral Tribunal is hereby extended until June 30, 2026. The Learned Arbitral Tribunal shall take a view on the appropriate costs that must be imposed at the time of passing of the final order.
