IN THE HIGH COURT OF JUDICATURE AT BOMBAY

ORDINARY ORIGINAL CIVIL JURISDICTION ARBITRATION PETITION NO. 299 OF 2024 Kajaria Ceramics Ltd

...Petitioner

Versus

DC Autosoft Pvt Ltd

...Respondent

Mr Dhananjay Athawale, for the Petitioner.

CORAM:

ARIF S. DOCTOR, J DATED:

10th October 2024 PC:- SHEPHALI SANJAY MORMARE 1.

This Petition is filed under Section 29A of the Arbitration and SHEPHALI SANJAY MORMARE Date: 2024.10.11 09:15:21 +0530 Conciliation Act 1996 for an extension of six months to complete the arbitral mandate. This is the first extension that is sought for. 2.

The Learned Counsel appearing on behalf of the Petitioner submits that the Arbitral Tribunal's mandate was expired on 5th October 2024. The arbitral proceedings are at the stage of filing of evidence. . It is, thus, that the time is sought for. 3.

I find sufficient cause has been made out for the grant of an extension of time.

8-ARBP-299-2024.DOC 4.

Hence, I am inclined to allow the Arbitration Petition in terms of prayer clause (a), which reads thus:

"(a) that the Honourable Court will be pleased to extend the period of arbitration by six more months from the date of the order."

5.

It is made clear that this shall be the final extension and that the period of six months to complete the mandate of the Tribunal shall commence from the date on which a copy of this order is uploaded. 6.

The Petition is accordingly disposed of.

(ARIF S. DOCTOR, J)
