IN THE HIGH COURT OF JUDICATURE AT BOMBAY

ORDINARY ORIGINAL CIVIL JURISDICTION ARBITRATION PETITION (L) NO.25648 OF 2024 Superior Aircorn Private Limited ... Petitioner V/s.

Union of India ... Respondent ----- Mr. Udaya Sankar Samudrala a/w Sujit Upadhyay for the Petitioner. Ms. Siddhi Vadake i/by Bharat Mehta for the Respondent. ----- CORAM :

ARIF S. DOCTOR, J.

DATE :

30TH AUGUST 2024 P.C. :

1.

This is a Petition filed under Section 29A of the Arbitration and Conciliation Act, 1996 for extension of the mandate of the arbitral tribunal. 2.

I am informed that the arbitral award is ready and it is for this purpose that the extension is sought for.

3.

Learned Counsel appearing on behalf of the Respondent initially opposed the grant of extension of time. She then however submitted that if time was to be extended to, further arguments should not be advanced. In the event, This order is modified/corrected as per order dated 30 th September 2024.

2 26-ARBP (L) 25648-24-modified.doc if any further arguments are to be advanced, it is always open to the Respondent to object the same before the Tribunal. 4.

Therefore, I am satisfied that sufficient progress has been made. In view of the above, I deem it fit to allow the present Petition. Thus, the present Petition is allowed in terms of prayer clause (a), which reads as under : "(a) this Hon'ble Court may be pleased to grant the extension of time for a period of One month from the date of passing of the Order by this Hon'ble Court and / or up to 3lSt August, 2024 for concluding the Arbitration Proceedings and publication of Arbitration Award in respect of the disputes between the Petitioner and the Respondents;"

5.

I make it clear that this extension of time is granted only for a period of one month from the date on which this order is being uploaded. 6.

The Arbitration Petition is thus disposed of. (ARIF S. DOCTOR, J.) This order is modified/corrected as per order dated 30 th September 2024.
