This is a Petition under Section 9 of the Arbitration and Conciliation Act, 1996.

Despite multiple rounds of service, none appears on behalf of the Respondent-Society. Learned Advocate for the Petitioner would explain that earlier, the disputes and differences leading to a termination were settled by way of Consent Terms which was approved by a Learned Single Judge of this Court on July 3, 2023. The said Consent Terms clearly record that the parties would proceed for redevelopment with the Petitioner-Society. Thereafter, it is seen from the correspondence between the parties that the Petitioner has August 4, 2025 Shraddha
515-ARBP-345-2025.doc worked with the Society to have the occupancy class converted for purposes of redevelopment. However, by a letter dated June 17, 2024, the Society has once again terminated the Petitioner's appointment as a developer. 3.
It would be important to hear the say of the Respondent, but despite service, none appears. In these circumstances, to give the Respondent a last chance to present their say, stand over to August 11, 2025. 4.
