This is the Arbitration Petition under Section 9 and as of the year 2024, it is contention of learned counsel appearing on behalf of the Petitioner that arbitration has been invoked by notice dated 7 th February, 2025. Learned counsel appearing on behalf of the Respondents disputes receipt of such notice. Be that as it may.

Mr. Shukla submits that an Arbitration Petition for appointment of an Arbitrator is being filed, he seeks leave to withdraw the present Petition with a liberty to file an appropriate application under Section 17 of the Arbitration and Conciliation Act, 1996. The Petition is thus dismissed as withdrawn with the aforesaid liberty.

The Petition is accordingly disposed of.
