Learned Counsel for the Petitioner submits that since the filing of the captioned Petition arbitration has been invoked by the Respondent Union of India (Railways), the Petitioner has also consented to the appointment of the Arbitrator. He thus seeks leave to withdraw this Petition with liberty to file a fresh petition under Section 17 of the Arbitration and Conciliation Act before the Learned Arbitrator.
