This is an Application under Section 11 of the Arbitration and Conciliation Act, 1996.

Having heard Learned Counsel for the parties, it would be appropriate to give them a week's time to indicate who they would proceed to for arbitration since mediation has failed. Leaving all contentions on merits open, the parties are at liberty to indicate the identity of the arbitrator and the venue where such arbitration shall take place, since the disputes and differences between the parties need to be resolved one way or the other.
