This Application has been filed under the provisions of Section 11 of the Arbitration and Conciliation Act, 1996 for appointment of an Arbitrator.

By an order dated 2 December 2022 passed by this Court, the Court had proposed to nominate Mr. Anuj Desai, a practising Advocate in this Court, as the Sole Arbitrator and had directed the proposed Arbitrator to file his disclosure by 9 December 2024. By the said order, the Respondent was also put to notice that the matter shall proceed ex-parte if they are not represented on the next date. Even today, despite notice and service, the Respondent is not present.

The proposed Arbitrator Mr. Anuj Desai has made a disclosure dated 6 December 2024 as required under the provisions of the Act. 4.

In these circumstances, the following order is passed :- (a) Mr. Anuj Desai, a practising Advocate of this Court, is appointed as the Arbitrator to Arbitrate upon the disputes and differences arising between the parties under the Tender Agreement dated 6 October 2022 entered into between them. (b) The Advocate for the Applicant shall intimate the Arbitrator about his appointment within a period of one week from the date of uploading of this order;

(c) In addition, the Office of the Prothonotary and Senior Master of this Court shall also intimate the Arbitrator about his appointment within a period of one week from the date of uploading of this order.

(e) The Arbitrator shall charge fees as per the Rules framed by this Court in that regard.

The Arbitration Application is disposed of in the aforesaid terms. There will be no order as to costs.
