Having heard the Learned Counsel for the Applicant, it is seen that invocation of arbitration was effected by way of a notice dated August 18, 2020. It is the case of the Learned Counsel for the Applicant that the Respondent has not contested the existence of the arbitration agreement or the desire to proceed to arbitration. 2.

However, considering that a reply to the invocation notice was also dated way back in August 24, 2020, it is important to get a precise computation of periods applicable for purposes of limitation, after factoring in the directions of the Supreme Court in Suo Motu Writ Petition (Civil) No.3 of 2020.

The Applicant shall file an affidavit enclosing evidence of the date of filing this Application, with the electronic acknowledgment generated by the server of this Court, along with a chart showing the computation of the limitation period, factoring in the period for which limitation was suspended by the Supreme Court. Should there be any delay upon effecting such computation, the reasons for such delay shall also be spelt out in the same affidavit.

Let such affidavit be filed no later than July 16, 2025. 5.

Stand over to July 23, 2025.

All actions required to be taken pursuant to this order shall be taken upon receipt of a downloaded copy as available on this Court's website.
