This is an adjourned meeting fixed for the private examination of the Insolvent touching her estate and affairs. 2.
Registry has placed before me letter dated 22nd July 2025 received from Ashok M. Saraogi, Advocate for the Insolvent stating that, the Insolvent has already settled the matter with the Petitioning Creditor and substantial amounts have already been paid as per settlement between the parties, however, Shri Girish Kedia, Ld. Advocate appearing on behalf of the Petitioning Creditor submits that only 50% amount / part payment paid through well-wisher of the Insolvent, balance 50% amount as per settlement not paid till date.

Private examination of the Insolvent was earlier placed on 19th June, 2025, 4th July, 2025 and today, however, all the occasion Insolvent remained absent. In all three occasion only in one meeting Advocate for the

Insolvent was present. This conduct of the Insolvent cannot be tolerated. Though the Insolvent want to settle the matter he has to remain present in the meeting before the Official Assignee for his private examination without fail. Until the settlement is going on and there is no annulment Order is obtained from the Hon'ble Insolvency Court, Insolvent has to attend the meeting before the Official Assignee, therefore, Insolvent is hereby directed to attend next meeting failing which the said conduct of the Insolvent may be brought to the notice of the Hon'ble Insolvency Court by taking out RULE NISI for not attending meeting. 4.
In the aforesaid letter, Advocate for the Insolvent has also requested to grant necessary permission to the Insolvent to travel at Udaipur to attend an urgent function.

Advocate for the Insolvent is directed to obtain necessary permission from the Hon'ble Insolvency Court. 6.
As per direction given in the memo dated 9th May, 2025 not to leave the jurisdiction until he obtain permission from the Hon'ble Insolvency Court.

On the last occasion in the meeting direction was issued to the Advocate for the Insolvent to serve copy of letter / correspondence he make with the Official Assignee to the Advocate for the Petitioning Creditor. Today, again letter asking for adjournment is received from the Advocate for the Insolvent but copy of the same not served upon the Advocate for the

Petitioning Creditor. Advocate for the Insolvent to take note for the same and make correspondence of the same.

Shri Amit Dubey i/by Ashok M. Sarogi, Advocate for the Insolvent present and submits that inadvertently he was waiting before the Insolvency Registrar, therefore, he could not attend meeting on time. He further submits that next time he will mark C.C. to the Advocate for the Petitioning Creditor if he will make any communication with the Official Assignee for any purpose. He further submits that his clients wants to settle the claim of the Petitioning Creditor. He has made part payment only. He undertakes to keep his client present on the next adjourned date.
