Heard the learned Counsel for the petitioner. 2.
This Judge's Order is taken out seeking permission to Sale the assets left behind by the deceased. i.e. Room No.A-22, Shreedatta CHS, Sector No.7, Plot No. AD-723, RSC-64, Charkop, Kandivali (West), Municipal "R" Ward, Mumbai. 3.
The Letters of Administration to the property and credits of the deceased Rajashri Mahadev Jadhav were granted by an order dated 17th April 2023. The deceased was survived by two sons and two daughters. Apart from the petitioner, another son Mahesh Mahadev Jadhav and daughters Jyoti Suryakant Lad and D.A.ETHAPE
27-JOT-108-2024 (OS).doc Akshata Ajay Pawar had given consent for the grant of Letters of Administration.

In the affidavit in support of the Judge's Order, the petitioner has affirmed that they have decided to sell the subject premises for a consideration of Rs.35 lakhs. A copy of the draft agreement for Sale is annexed at Exhibit-C. The petitioner has undertaken to distribute the said proceed amongst the legal heirs of the deceased as per law. Jyoti S. Lad, Akshata A. Pawar and Mahesh M. Jadhav have filed joint affidavit giving consent for the sale of the subject premises.

In view of the affidavit in support of the Judge's Order, the documents annexed thereto and consent affidavit of the other legal heirs, I am satisfied that permission can be granted to sell the subject premises.
