Heard the learned Counsel for the Petitioner. 2.

This Judge's Order is taken out to dispense with the office requisition to justify the share of non consenting heir Anil Karan Puri. 3.

I have perused the affidavit in support of the Judge's Order. In the affidavit in support of the Judge's Order, it is affirmed that the citation has been duly served on Anil Karan Puri. An affidavit of service of the Bailiff attached to the Office of the Sheriff of Mumbai has been filed. I have perused the affidavit of Pravin V. Kajrekar, Bailiff employed in the Office of the Sheriff of Mumbai, in proof of the service of the citation. 4.

Mr. Anil Karan Puri has not appeared before the Court. Nor a caveat has been entered.

In the affidavit in support of the Judge's Order, the Petitioner has SSP 1/2

3 jot 115 of 2024.doc undertaken to transfer the share of the non-consenting heir within 16 weeks of the grant of the Letters of Administration and deposit the transfer deed with the office of the Prothonotary and Senior Master. 6.

In view of the averments in the affidavit in support of the Judge's Order and the undertakings of the Petitioner, I am inclined to dispense with the office requisition to justify the surety for the non-consenting heir. 7.
