Heard the learned Counsel for the Petitioner. 2.

This Judge's Order is taken out seeking permission of the Court for sale of House No.54D, situated at Plot No.54D, Phase II of Sree Nivas Gardens Situated at Kakayanthoppu, Ariyankuppan, Pondichery - 605 007 (the subject premises).

The Letters of Administration to the property and credits of Anup S. Mondal were granted by an order dated 2 December 2023. The deceased is survived by the Petitioner and son Shounak A. Mondal. In the affidavit in support of the Judge's Order, the Petitioner asserts that she has entered into an agreement for sale of the subject premises for a consideration of Rs.29,50,000/-. A copy of the agreement for sale is annexed to the affidavit.

Shounak A. Mondal, son of the deceased and the Petitioner, has filed an affidavit dated 18 June 2024 giving his consent for the sale of the subject premises. The Petitioner has undertaken to distribute the sale proceeds to the other legal heir/s of the deceased in accordance with law.

I am satisfied that permission to sell the subject premises can be granted.
