This Judge's Order is taken out to seeking permission to sell the property i.e. Room No.125, Building No.3, Ashtavinayak (SRA) Co-operative Housing Society Ltd., Bandra (East), Mumbai, belonging to the deceased Baby Krishna Powar alias Bebi Krishna Powar (the deceased). 3.
In TP/3951/2023, pursuant to an order dated 2nd May, 2024 Letters of Administration with Will annexed to the property and credits of the deceased have been granted to the petitioner, being one of the legal representatives of the sole legatee named under the said Will. Pursuant to the aforesaid 1/2
19JOT130-2024.DOC grant of Letter of Administration, the said property has been transferred in the name of the petitioner in the record of Ashtavinayak (SRA) Co-operative Housing Society Ltd., Bandra (East), Mumbai.

The petitioner desires to sell the subject premises. An agreement has been executed between the petitioner and Ms. Tanisha Chetan Kumar Shende, the prospective purchaser, for the sale of the subject premises, for a consideration of Rs.53,00,000/-.

I have perused the affidavit in support of the Judge's Order. The petitioner has affirmed that the other legal heirs of the deceased have filed affidavits giving their consent for the sale of subject premises. The petitioner has undertaken to distribute the said proceeds amongst the heirs of the deceased in accordance with their respective shares. The consent affidavits of the heirs of the deceased are filed at Exhibits 'E' to 'I'. I am satisfied that permission for sale of the subject premises can be granted.
