Heard the learned Counsel for the Petitioner. 2.
The Judge's Order is taken out seeking permission of the Court to gift immovable property i.e. tenanted premises Room No. 29, Vikrant Sadan, "A" Wing, Ground Floor, D. M. Khamkar Marg, Gas Company Lane, Lalbaug, Mumbai, in respect of which the Letters of Administration have been granted in favour of the petitioner by an order dated 27th February 2024. 3.
Perused the affidavit in support of the Judge's Order. 4.
The Letters of Administration to the property and credits of Ramshankar Shivshankar Shukla, the father of the petitioner, D.A.ETHAPE
16-JOT-141-2024 (OS).doc were granted in favour of the petitioner, being the only son of the deceased. The wife of the deceased had predeceased the deceased. Post grant, the subject flat has been transferred in the name of the petitioner. In the affidavit in support of the Judge's Order it is affirmed that, the petitioner desires to gift the subject property to his son Ratnesh Ramakant Shukla. A copy of the draft gift deed is annexed to the application in support of the Judge's Order.

It appears that the petitioner desires to gift the subject property to his son out of natural love and affection. I do not find any impediment in granting permission to gift the subject property.
