The present Suit is a Suit for administration of the estate of one Pannalal Jawatraj Sharma ("the deceased"). The Plaintiffs before me are the wife and daughter of the deceased and the Defendants are the sons of the deceased. 2.
Since this is a dispute between family members, I put to Learned
2 9-S(L)-25202-2024.doc Counsel if their respective clients were willing to attempt to resolve their disputes and differences through mediation. Both Learned Counsel submitted that their respective clients were ready and willing to submit their disputes and differences into mediation in an attempt to find resolution. 3.
Mr. Andhyarujina, Learned Counsel for Defendant No. 2 very fairly stated that his clients were not disputing the fact that the Plaintiffs has a 1/6 share in the estate of the deceased. He, however, disputed the claims made in the Plaint as a whole.

Given this, I appoint S. J. Kathawalla, former Judge of this Court to act as mediator in the matter. The details of the Learned Mediator are as follows:

The necessary costs, charges and expenses of the mediator to be borne equally by the parties.

Today, since I have not taken up the matter for ad-interim relief because of the possibility of settlement, I request the learned Mediator to conduct the mediation proceedings as expeditiously as possible subject to all his other commitment and exigencies.
