Heard Mr. Rastogi, learned Counsel for the Petitioner, and Ms. Jyoti Chavan, learned Additional G.P. for the State of Maharashtra-Respondent Nos. 1 to 5.

By this Petition, the Petitioner seeks a refund of an amount of Rs.6,72,39,832/- from the Respondents along with interest at the rate of 18% per annum.

Mr. Rastogi, learned Counsel for the Petitioner, on instructions, fairly points out that by now an amount of approximately Rs.4.91 Crores has already been refunded to the Petitioner. He submits that if the Petitioner is now permitted to file a fresh application by reconciling the accounts and if some directions are issued to the Respondents to decide the same in a

24-WP-739-25.DOCX time-bound manner, the Petitioner, for the present, would be satisfied. He submits that in case the Petitioner is not satisfied with the reliefs that may be granted on the Petitioner's fresh representation, liberty may be granted to the Petitioner to take appropriate steps for redressal.

The suggestion made by Mr. Rastogi appears to be reasonable. Accordingly, the Petitioner is granted liberty to file a representation for seeking a refund along with interest which, according to the Petitioner, is still due to the Petitioner. Mr. Rastogi states that such a representation would be filed along with a statement of reconciliation within three weeks from today. The concerned Respondents are directed to dispose of such a representation within eight weeks of its receipt. The concerned Respondents should hear the Petitioner's representation and pass and communicate a reasoned order on the same. 5.

If the Petitioner is still aggrieved, the Petitioner shall have liberty to take appropriate steps to seek redressal. 6.

All contentions of all parties on merits are explicitly left open.

This Petition is disposed of in the above terms without any order as to costs.
