DATED:
PC:- WRIT PETITION (L) NO. 11522 OF 2024 1.
Learned counsel for the Petitioner, based on instructions from the Petitioner seeks leave to withdraw this Petition unconditionally. Leave is granted and this Petition is disposed of as withdrawn unconditionally.
WRIT PETITION NO. 959 OF 2024 2.
Heard learned counsel for the parties.
3.
The grievance in this Petition is that the Petitioner's Applications for further development permission of existing buildings on plot bearing CTS No. 310, 310/1 to 9, 309 of village Poisar, at Vivekanand Road, Kandivalil (W), Mumbai are not being disposed of by the Municipal Corporation of Greater Mumbai ("MCGM").
4.
Mr Godbole, learned Senior Advocate for the Petitioner submits that this delay is on account of intervention of MP. He submits that by communication dated 30th May 2022, the Petitioner was called upon to clarify some matters at the behest of this MP. He submits that the Petitioner, without prejudice, has submitted such clarifications.
5.
Ms Sonawane learned counsel for the MCGM states that the MCGM will dispose of the Petitioner's Applications in accordance with law and on their own merit within a week from today. We accept this statement and direct the MCGM to act accordingly. The MCGM must communicate its decision to the Petitioner within a maximum period of 10 days from today.
6.
The Petition is disposed of in above terms without any orders for costs.
INTERIM APPLICATION (L) NO. 11467 OF 2024 7.
The Interim Application seeking intervention does not survive because we have basically recorded the statement on behalf of the MCGM and disposed of the Petition.
8.
Accordingly, even the Interim Application is disposed of. (Kamal Khata, J) (M.S. Sonak, J)
