By the present Writ Petition filed under Article 226 of the Constitution of India, the Petitioner is challenging the legality and validity of order dated 20th January 2023 passed in Complaint (ULP) No.108 of 2019 by the learned Judge, 10th Labour Court, Mumbai and order dated 23rd October 2023 passed by the learned Member, Industrial Court, Mumbai in Revision Application (ULP) No.18 of 2023.

Learned Counsel appearing for the Petitioner and the learned Counsel appearing for the Respondent No.2 state that parties have settled the dispute and executed the Consent Terms. Both of them tendered the Consent Terms. The Consent Terms are signed by Mr. Mayuresh Joshi, Senior Manager (HR) on behalf of the Petitioner-Company and by Mr. Sandeep Kadam, Executive President of the Respondent No.2-Union. The Consent Terms are also signed by the learned Advocates appearing for the respective parties. Both the learned Advocates identify the signature of the respective parties.

Learned Counsel appearing for the Petitioner states that Mr. Mayuresh Joshi, Senior Manager (HR) is authorized by the Petitioner-Company to execute the Consent Terms. The resolution of the Petitioner-Company is annexed to the Consent Terms. Learned Counsel appearing for the Respondent No.2 states that Mr. Sandeep Kadam, Executive President is authorized by the Respondent No.2-Union to execute the Consent Terms. 4.

Accordingly, the Consent Terms are taken on record and marked 'X' for identification.

A soft copy of the Consent Terms will be uploaded as the second order in the matter.

Accordingly, the Writ Petition is disposed of in terms of the Consent Terms.

Resultantly, the impugned order dated 20th January 2023 passed in Complaint (ULP) No.108 of 2019 by the learned Judge, 10th Labour Court, Mumbai and order dated 23rd October 2023 passed by the learned Member, Industrial Court, Mumbai in Revision Application (ULP) No.18 of 2023 are quashed and set aside and said Complaint (ULP) No.108 of 2019 is disposed of in terms of the Consent Terms.
