Aggrieved by the order contained in the letter dated 4th January 2022 by which approval for appointment of the petitioner as Senior Clerk has been declined by the Education Inspector, Brihanmumbai, Western Division-respondent no.3, the petitioner has challenged the legality of the said order.

A copy of the reply affidavit filed by the respondent no.3 is taken on record. In this reply affidavit, the respondent no.3 relies on a Government Resolution issued on 27th March 2024 whereunder it is provided that the decisions of the respondent-State taken prior to 1st January 2024 shall be looked into by the Grievance Redressal Committee constituted by the said Resolution. However, we are inclined to observe that the fixing of a cut-off date on constitution of a Grievance Redressal Committee seems to be arbitrary. The fixing of such a cut-off date shall create a peculiar situation before the Committee and this Court inasmuch as few of the aggrieved persons shall have an additional forum in the writ Court to agitate their grievance by challenging the decision taken by the Grievance Redressal Committee. 1/2 Kartikeya Goti

In that view of the matter, we permit the petitioner to approach the Grievance Redressal Committee by filing an appropriate petition which shall be dealt with in accordance with and as applicable under the Maharashtra Employees of Private Schools (Conditions of Service) Regulation Act, 1977 and the Government Resolutions for approval of the post. However, we must indicate that we have not reflected on the merits of the matter or the opposition raised by the respondent no.3 in the affidavit dated 17th June 2025.

Writ Petition No.1209 of 2025 is disposed of with the aforesaid liberty to the petitioner.
