We have heard learned counsel for the RespondentsCorporation. Learned counsel for the Respondents-Corporation requested for some time. However, considering the nature of the order which we propose to, we requested learned counsel for the Corporation to go through the Petition and respond as detailed instructions at this stage may not be necessary.

The Petitioners are the owners of the property on which there is illegal and unauthorized structure allegedly made by Respondent No.3. It is the allegation of the Petitioners that the structure which has been constructed by the Respondent No.3 is an unauthorized one on Satish Sangar 1/2

14-WP-1476-2026.doc the open space behind the Shivsena Shakha No.163 of the property bearing CTS No.40 of revenue village, Kurla-I, Taluka-Kurla situated at Kajupada Pipe Line, Kurla (West) within the Municipal limits of "L" Ward of Mumbai Municipal Corporation.

The Petitioners have made a complaint against unknown local residents for commencing unauthorized and illegal work which is at Page No.26 of the paper-book. The Writ Petition can be, therefore, disposed of by directing the Respondent No.2-The Assistant Municipal Commissioner, "L" Ward or the Designated Officer to look into the complaint dated 30th August 2024 made by the Petitioners and if he finds any substance in the complaint, appropriate action be taken against the unauthorized structure in accordance with law. Such action be taken expeditiously preferably within a period of 12 weeks from the date of communication of this order. 4.
