This petition under Article 226 of the Constitution of India is filed praying for the following substantive relief: - "(a) That a writ of certiorari, writ of mandamus or any other appropriate writ, order or direction be issued calling for the records and after examining the legality and propriety of the application be ordered and directed respondent No.2 to decide the said application/Jodpatra III dated 21st December, 2015 within time bound schedule."

Mr. Lad, learned counsel for the MHADA, on instructions, submits that the Deputy Chief Officer (Marketing) is the competent authority which would decide the petitioner's application dated 21.12.2015. 3.

In this view of the matter, we are of the opinion that this petition can be disposed of keeping open all contentions of the parties to enable the Deputy Chief Officer (Marketing) to consider the petitioner's application in Amk 1/2

22-wp 1480-24.doc question which be decided on its own merits as expeditiously as possible and in any event within a period of four weeks from today. 4.

At the first instance, the petitioner is directed to appear before the said authority on 19.09.2025 at 3.00 p.m. so that further appropriate date can be fixed and the petitioner can be heard and appropriate orders passed.
